These Terms of Service ("ToS") govern the specific operational and technical terms under which MrMoreira ("Company", "we", "us", or "our") provides game server hosting services to you ("Client", "User", or "you") through the MrMoreira Hosting platform at https://mrmoreira.com. These Terms of Service are supplementary to and should be read together with our Terms and Conditions, which contain the broader legal framework governing your relationship with MrMoreira. By purchasing, activating, or using any hosting service, you agree to abide by these Terms of Service in full.
1. Service Description
MrMoreira Hosting provides managed and self-managed game server hosting services for a variety of supported game titles, including but not limited to Minecraft, Terraria, and ARK: Survival Evolved. Our services are delivered using our own dedicated Infrastructure, which consists of physical servers located in data centers in the State of São Paulo, Brazil.
Each hosting plan includes a defined allocation of resources (CPU, RAM, disk space, and bandwidth) as described on our website at the time of purchase. The Client acknowledges that the actual performance of game servers may vary depending on factors such as the number of players, the use of mods or plugins, world size, and the complexity of the game being hosted.
We provide a web-based management panel that allows Clients to start, stop, restart, configure, and monitor their game servers. The specific features available through the panel may vary by game title and service plan.
MrMoreira owns and operates all Infrastructure used to deliver the services. We are not a reseller, and we maintain full control over our hardware, network, and software stack to ensure the highest possible quality and reliability.
2. Service Activation and Delivery
Service activation begins upon confirmation of payment. For most payment methods, activation is automatic and occurs within minutes. For certain payment methods (such as bank transfers or manual PIX), activation may take up to 24 hours while payment is verified.
Upon activation, the Client will receive access credentials and instructions for managing their server. The Client is responsible for the initial configuration and setup of their game server, including the installation of mods, plugins, and game settings, unless otherwise specified in the purchased plan.
MrMoreira provides setup assistance and technical support to help Clients with initial configuration, but we are not responsible for the functionality, compatibility, or performance of third-party software (mods, plugins, maps, or custom configurations) installed by the Client.
3. Service Level and Availability
MrMoreira strives to provide the highest possible uptime and service availability. However, unless a separate Service Level Agreement (SLA) has been executed between MrMoreira and the Client, no specific uptime guarantee is provided.
Planned maintenance will be performed during low-traffic hours whenever possible, and we will make reasonable efforts to notify Clients in advance via email or through the management panel.
Unplanned outages may occur due to hardware failures, network issues, security incidents, software bugs, or other unforeseen events. We will work diligently to restore service as quickly as possible.
The following events are excluded from any availability or performance commitments: (a) scheduled maintenance; (b) force majeure events; (c) denial-of-service attacks or other security incidents; (d) issues caused by Client actions or third-party software; (e) upstream network or power outages beyond our control.
4. Resource Allocation and Fair Use
Each service plan includes a specific allocation of resources as described at the time of purchase. MrMoreira does not oversell resources — the RAM, CPU, and storage allocated to your server are dedicated to your service.
However, Clients must use their allocated resources reasonably and in accordance with the intended purpose of the service (game server hosting). The following activities constitute resource abuse and may result in service throttling, suspension, or termination:
(a) Running non-game-related applications, services, or processes on the server (cryptocurrency mining, file hosting, web servers, proxy services, etc.) unless explicitly authorized.
(b) Intentionally consuming excessive CPU, disk I/O, or network bandwidth in a manner that impacts our Infrastructure or other Clients' services.
(c) Using the server as a relay, proxy, VPN endpoint, or for any purpose other than game server hosting.
(d) Deploying automated scripts, bots, or processes that generate excessive resource consumption without legitimate gaming purpose.
We reserve the right to monitor resource usage and to take corrective action, including throttling, suspending, or terminating services, when resource abuse is detected.
5. Acceptable Use of Hosting Services
In addition to the Acceptable Use Policy defined in our Terms and Conditions, the following specific rules apply to the use of our hosting services:
(a) Game Server Content: Clients are responsible for all content hosted on their game servers, including player-generated content, mods, custom maps, and configurations. Content that is illegal, infringing, abusive, or harmful is strictly prohibited.
(b) Player Management: Clients who operate public game servers are responsible for moderating player behavior within their servers. MrMoreira is not responsible for the actions of individual players on Client-operated servers.
(c) Network Conduct: Clients must not use their servers to disrupt, attack, or interfere with other servers, networks, or services. Any evidence of malicious network activity originating from a Client's server will result in immediate suspension.
(d) Software Compliance: Clients must ensure that all software, mods, and plugins installed on their servers are properly licensed and do not violate any intellectual property rights or software license agreements.
(e) Cooperation with Law Enforcement: MrMoreira will cooperate fully with law enforcement agencies and regulatory authorities when legally required. This may include disclosing Client data, server logs, and IP addresses in response to valid legal requests, court orders, or subpoenas.
6. Backup and Data Management
6.1. Client Responsibility: The Client is primarily responsible for maintaining regular backups of all server data, including game worlds, configurations, plugins, mods, and any other files. MrMoreira strongly recommends that Clients periodically download their data to local storage.
6.2. Manual Backup Tools: We provide optional manual backup functionality through the management panel. Clients can initiate backups on demand. The number of backup slots and the retention period may vary by service plan.
6.3. Backblaze Off-Site Storage: When a manual backup is created, the backup file may be automatically transmitted to Backblaze B2 Cloud Storage for off-site redundancy. Backblaze is a third-party storage partner, and its services are governed by its own terms and policies. MrMoreira does not guarantee the availability, integrity, or recoverability of data stored on Backblaze.
6.4. No Automatic Backups: Unless explicitly stated in the service plan, MrMoreira does not perform automatic scheduled backups of Client data. The Client is solely responsible for initiating backups and verifying their integrity.
6.5. Data Recovery: In the event of data loss, MrMoreira will make commercially reasonable efforts to assist with recovery, but we do not guarantee that data can be recovered. Recovery services, if available, may be subject to additional fees.
6.6. Recommendation: We strongly recommend that all Clients maintain at least one recent copy of their server data on local storage (personal computer, external hard drive, or personal cloud storage) at all times. Do not rely solely on our backup tools or Backblaze storage as your only backup.
7. Technical Support
MrMoreira provides technical support to all active Clients through our official support channels (ticket system, Discord, and email).
Our support covers: (a) server management panel issues; (b) service activation and billing inquiries; (c) network and connectivity issues related to our Infrastructure; (d) basic game server configuration assistance; (e) backup and restore assistance.
Our support does not cover: (a) in-depth customization of mods, plugins, or game configurations; (b) troubleshooting of third-party software not provided by MrMoreira; (c) game development, scripting, or programming assistance; (d) issues caused by Client actions, including data loss, misconfiguration, or security breaches resulting from Client negligence.
Support response times may vary based on the complexity of the issue and current support volume. We aim to respond to all inquiries within 24 hours during business days.
8. Suspension and Termination of Service
MrMoreira reserves the right to suspend or terminate any service, with or without prior notice, in the following circumstances:
(a) Violation of these Terms of Service or our Terms and Conditions.
(b) Non-payment or repeated late payment of invoices.
(c) Resource abuse or excessive consumption as defined in Section 4.
(d) Hosting of illegal, infringing, abusive, or harmful content.
(e) Engagement in fraudulent chargebacks or payment disputes.
(f) Malicious network activity originating from the Client's server.
(g) A valid request from law enforcement or a court order.
(h) Any activity that threatens the stability, security, or reputation of our Infrastructure or services.
In cases of suspension, we will make reasonable efforts to notify the Client and provide an opportunity to remedy the violation before termination, except in cases of severe violations (illegal activity, fraud, or security threats), where immediate termination without notice is warranted.
Upon termination, the Client's service will be deactivated, and data may be deleted in accordance with Section 6 and the Data policies in our Terms and Conditions.
9. Refund Policy for Hosting Services
Refunds for hosting services are governed by the Refund Policy outlined in Section 5 of our Terms and Conditions. The following additional provisions apply specifically to hosting services:
(a) Services that have been extensively used (significant data upload, extended server operation, or high resource consumption) during the refund window may be subject to a partial refund, reflecting the resources consumed.
(b) Refunds are not available for services that were suspended or terminated due to violation of these Terms of Service or our Terms and Conditions.
(c) Custom configurations, setup services, or one-time service fees are non-refundable.
(d) Domain registrations, add-on services, or third-party licenses purchased in conjunction with hosting services may have separate refund policies and are not covered by our standard refund policy.
10. Limitation of Liability for Hosting Services
In addition to the Limitation of Liability set forth in our Terms and Conditions, the following specific limitations apply to hosting services:
(a) MrMoreira is not liable for game server downtime, lag, performance issues, or connectivity problems caused by factors beyond our control, including but not limited to: game developer patches or updates, DDoS attacks, upstream network issues, client-side connectivity problems, or third-party software conflicts.
(b) MrMoreira is not liable for any loss of in-game progress, virtual items, player data, or game-related content, whether arising from technical issues, service interruptions, or any other cause.
(c) MrMoreira is not liable for the actions of other players on Client-operated game servers.
(d) The total liability of MrMoreira for claims related to hosting services shall not exceed the amount paid by the Client for the specific hosting plan giving rise to the claim during the three (3) months immediately preceding the event.
11. Changes to These Terms of Service
MrMoreira reserves the right to update, modify, or replace these Terms of Service at any time. When we make material changes, we will:
(a) Update the "Last updated" date at the top of this document.
(b) Notify affected Clients via email or through the management panel.
(c) Provide at least fifteen (15) days' notice before the changes take effect.
Continued use of our services after the effective date of the updated Terms of Service constitutes acceptance of the changes. If you do not agree to the updated Terms, you must discontinue use of the services and may request a prorated refund for any prepaid, unused service period.
12. Governing Law and Dispute Resolution
These Terms of Service are governed by the same legal framework described in Section 14 (Governing Law and Jurisdiction) of our Terms and Conditions.
For disputes specifically related to hosting services, the parties agree to first attempt resolution through our support team. If a resolution cannot be reached through support, the dispute escalation process described in our Terms and Conditions shall apply.
Clients located in Brazil may also seek resolution through the platform consumidor.gov.br or through the competent Small Claims Court (Juizado Especial CÃvel), as applicable.
